WHEN IS MY COURT DATE?

CAN I CHANGE MY COURT DATE?

The citation is your official summons to appear in court on the designated date and time. If you need to reschedule your court date, the request must be submitted no later than ten (10) days prior to your arraignment.

Reset request forms can be completed in person at the Court or downloaded online and mailed in. If your case is reset for a new court date, you will receive a notice in the mail and the date will be displayed online under events. Your reset request is at the sole discretion of the Court. A reset request is not guaranteed and may result in an FTA if not approved by the Judge.

CAN I GET AN EARLIER COURT DATE THAN THE ONE ON MY CITATION?

WHAT IF I LIVE OUT OF STATE?

If you are an out-of-state driver you may be eligible to enter a Plea in Absentia. To apply you must complete an application, and the Solicitor’s Office will notify you if you’re accepted.

WHAT IF THE WEBSITE SAYS “CONV” BESIDE MY CASE?

Your citation has been received but your courtroom and time is not assigned. Please check the court website regularly for updates. You will also receive a notice via mail at the address listed on your citation.

I MOVED. HOW DO I CHANGE MY ADDRESS WITH THE COURT?

If you wish to update your address with the Court, please submit a Change of Address Form and include your state-issued ID with the updated address. If your case has been bound over to a higher court, you will need to contact that court to change your address.

DOES THE COURT OFFER ALTERNATIVE SENTENCING PROGRAMS?

Yes. Entry into an alternative sentencing program is at the Judges’ discretion. Restore Atlanta oversees the following alternative sentencing programs: Teens Learning Control, Restorative Justice, Clinical and the Homeless Court Program.

WHAT IS TRIP?

Tax Refund Intercept Program (TRIP) allows Georgia courts to collect unpaid fines and fees through your tax refund.

WHAT IF MY CAR HAS BEEN TOWED?

It is no longer required to visit Atlanta Police Property to receive a vehicle release for impounded vehicles. Vehicles are now released directly from the impound company. If your car was impounded based on your failure to pay parking citations, please note that all parking tickets must be paid before the vehicle is released from the impound company.

WHAT ARE THE POSSIBLE OUTCOMES OF MY CASE?

If you enter a guilty plea or a nolo contendere plea you will be required to satisfy the ruling of the court. This may include paying a fine, payable by cash, debit, or credit card. Some offenses can also result in mandatory jail time. Additionally, you can be ordered to complete community service or educational programs at the discretion of the judge. If you wish to contest the charges you could receive a bench trial or if you request a jury trial, your case will be bound over to the appropriate court of jurisdiction.

WHAT IS FAILURE TO APPEAR (FTA) COURT?

FTA Court is a specialty court that will hear a case in FTA and/or warrant status. If you’ve missed your court date, you are in FTA and/or warrant status.

You are in Failure to Appear (FTA) and/or warrant status. See FAQ HOW DO I RESOLVE MY FAILURE TO APPEAR (FTA)? below for further instructions.

WHAT IF I MISSED MY COURT DATE WHILE ON BOND?

You are in jeopardy of having your bond forfeited and are at risk of re-arrest. You need to make contact in person with the Court immediately to register for FTA Court FAQ. If you have a bail bondsman, you should make contact with that company and the Court immediately.

HOW DO I RESOLVE MY FAILURE TO APPEAR (FTA)?

To address your FTA, you must request a new court date via the FTA reset request form, which is available in person. You will receive a notice to appear in the mail for your designated date and time for FTA Court using the address listed on your citation. If you’ve moved see FAQ I HAVE MOVED. You may also address your FTA by resolving your case by paying the fine (if it is a charge listed on the Traffic Violations Bureau list). Please note that not all offenses are eligible for payment. Also note, that additional court fees and FTA fines may be assessed.

WHAT HAPPENS IF MY LICENSE IS SUSPENDED BECAUSE OF A FAILURE TO APPEAR (FTA)?

You will need to request a new court date to clear your FTA. If this is your first FTA on this case, your license will be reinstated as required by law once the request is made. However, if this is a second or subsequent FTA, license reinstatement is in the discretion of the judge. For more information, visit the DDS website at www.dds.ga.gov

WHAT IF I HAVE A WARRANT?

If the court issued a warrant for your arrest based on your failure to appear, you are at risk of arrest until the warrant has been cleared by the Judge who issued the warrant. See FAQ “HOW DO I RESOLVE MY FAILURE TO APPEAR (FTA)?”

BOND

WILL MY CASH BOND BE REFUNDED ONCE MY CASE IS OVER?

If you are the surety or the surety authorizes its use, any fines, fees, and court costs can be deducted from your cash bond amount. The remainder will be refunded to you or the surety that posted the bond. The Finance Department can assist you with processing your cash bond. Power of Attorney filed with the Court specifically allowing the fines to be paid without the surety’s appearance along with a copy of the surety’s photo identification.

WILL MY BOND BE REFUNDED IF MY CASE IS SENT TO A HIGHER COURT?

If your case has been bound over to a higher court, the bond will be transferred with the case to the appropriate court of jurisdiction.

CAN I STILL CLAIM MY BOND REFUND AFTER TWO (2) YEARS HAVE PASSED?

No. If any cash bail posted is not later claimed after two (2) years from the earlier of either the date of release or the date of the final disposition of the case, then the bond will be transferred and paid into the city or county having trial venue of the case. However, the refund is deemed forfeited if the surety has not claimed the refund within ninety (90) days after mailed notice of the refund’s availability to the surety’s last known address.
